What STAY is

STAY is Kerteminde Municipality’s local accommodation platform. We provide tools for listings and accommodation inquiries between guests and hosts. We act solely as an intermediary and are not a party to any rental agreement.

Who contracts with whom:

When a guest submits an inquiry through STAY, they contact the host directly. Any agreement regarding accommodation is made solely between the guest and the host. Hosts set their own prices, rules and cancellation terms and must keep their listings accurate, safe and lawful. Guests agree to follow the host’s rules and treat the property with care.

Please note that only private homeowners are allowed to sign up. STAY is intended as a supplement to the existing commercial accommodation sector. We reserve the right to remove listings from commercial operators.

Verification:

To rent out via STAY, hosts must verify their identity using passport or driver’s licence. This helps create a safer experience for both guests and hosts.

Payments:

Payments for accommodation take place directly between the guest and the host and are not processed through the platform.

Liability and disputes:

STAY does not guarantee or manage stays and does not mediate disputes. Any disagreements, cancellations or damages must be resolved directly between host and guest. To the extent permitted by Danish law, our liability is limited to providing access to the platform and its communication tools.

Personal data is processed under our Privacy Policy and GDPR. These terms are governed by Danish law. Please read the full Platform Terms below before using STAY.

Full version

STAY (“the platform”) is operated by the Kerteminde Business Foundation (the legal operator, acting under the name
ETKerteminde).
The technical operation, maintenance, administration and support of the platform are carried out by SevenYellowMonkeys on behalf of ETKerteminde.

The platform provides digital tools for listings and accommodation inquiries between hosts (homeowners or authorised tenants) and guests (visitors).

Please note that only private homeowners are allowed to sign up. STAY is intended as a supplement to the existing commercial accommodation sector. We reserve the right to remove listings from commercial operators.

STAY acts solely as an intermediary — a facilitator of contact — and is not a party to any rental agreement formed between host and guest.

All communication, agreements, payments and obligations related to accommodation take place directly between the host and the guest.

The platform operates under:
  • Danish law, including the E-Commerce Act (Lov om tjenester i informationssamfundet, nr. 227 af 22. april 2002), which implements the EU Directive 2000/31/EC on electronic commerce.
  • The rules of Danish contract law (aftaleret), under which an intermediary that merely facilitates contact between independent parties is not considered a contracting party.
3a. Host Listings

Host listings are available exclusively to private individuals.

  • enables hosts to create listings, add descriptions, set prices, and define house rules;
  • allows guests to search, communicate, and send inquiries directly to hosts;
  • Hotels, professional accommodation providers and similar commercial operators are not eligible to list accommodation on the platform;
  • the platform does not own, rent, manage, inspect, or guarantee any accommodation listed on the site;
  • all listings, photos, descriptions, prices, availability, and house rules are created and maintained solely by the host;
  • the platform does not act as a booking agent, travel agency, housing agent, landlord, payment provider, or guarantor.
  • Pricing: DKK 399 per year for a standard accommodation listing and DKK 499 per year for a featured accommodation listing.

3b. Local Business Profiles

Local Business profiles are a separate service from accommodation listings.

  • Local businesses can create a profile on the platform to present their business to visitors;
  • Local Business profiles are intended for restaurants, shops, attractions, cultural venues, and other local businesses;
  • the service provides visibility and profile presentation for businesses and does not include accommodation listings, booking functionality, or payment handling;
  • Pricing: DKK 499 per year for a standard Local Business profile and DKK 599 per year for a featured Local Business profile.

When a guest submits an inquiry through the platform, the guest contacts the host directly. Any rental agreement is formed solely between the host and the guest. The platform is not and will not become a party to this agreement. Hosts are responsible for:
  • ensuring their property is safe, clean, and accurately described;
  • complying with Danish law, including municipal rules on short-term rentals and tax obligations;
  • maintaining appropriate insurance (e.g., contents or liability coverage).
Guests are responsible for:
  • treating the property with care and respecting the host’s rules;
  • understanding the host’s cancellation and refund terms before confirming a stay directly with the host.

Payments for accommodation take place directly between the guest and the host and are not processed through the platform.

5a. Platform Fees, Currency and VAT

  • The price for creating a standard accommodation listing on the platform is DKK 399 as a one-time fee, valid through 2026.
  • An optional featured accommodation listing can be purchased for DKK 499 as a one-time fee, valid through 2026.
  • The price for creating a standard Local Business profile is DKK 499 as a one-time fee, valid through 2026.
  • An optional featured Local Business profile can be purchased for DKK 599 as a one-time fee, valid through 2026.
  • All prices are stated in DKK (Danish kroner) and are inclusive of VAT, unless explicitly stated otherwise.

5b. Access to the Platform

Access to the platform is granted once account creation has been completed.
For hosts, access to listing functionality is activated once the listing has been created and the applicable platform fee has been paid.

The platform is not liable for:
  • cancellations, damages, losses, or disputes between host and guest;
  • inaccuracies, omissions, or misrepresentations in user-generated content;
  • unavailability or technical errors caused by third-party systems.
The platform’s responsibility is limited to providing access to its digital services and communication tools. To the extent permitted by Danish law, the platform shall not be held responsible for indirect or consequential loss, and liability for gross negligence or intent shall follow general Danish legal principles (culpa-ansvar).
6A. Accommodation Complaints
STAY provides access to a digital platform and does not sell goods or accommodation. Accordingly, the Danish Sale of Goods Act, including the statutory 2-year right of complaint, does not apply to accommodation provided by hosts through the platform. Any complaints regarding accommodation or stays must be directed to the host.
  • All disagreements, claims or damages arising from an inquiry, agreement or stay are to be resolved directly between host and guest.
  • The platform does not mediate, arbitrate, or decide on disputes.
However, message history and communication records within the platform can be used by the parties as documentation for private resolution or insurance purposes.
  • These Terms and any disputes arising from or relating to the platform are governed by Danish law.
  • Venue and jurisdiction rest with the District Court of Odense (Retten i Odense), unless mandatory consumer protection rules dictate otherwise.
  • By creating an account, listing a property, or submitting an inquiry, you acknowledge that you have read, understood, and accepted these platform Terms, including the platform’s Privacy Policy and any rules relevant to your user type (Host, Guest, or Business).
  • If you do not agree to these conditions, you must not use or access the platform.
