When you inquire about accommodation through STAY, you are contacting the host directly. Any agreement regarding accommodation is made solely between you and the host, outside the platform.

The portal acts solely as an intermediary for listings and communication.

All listings are managed by the individual hosts, who set their own prices, house rules and cancellation policies. Please read these carefully before making inquiries.

Verification
To rent out via STAY, hosts must verify their identity using passport or driver’s licence. This ensures security for both guests and hosts.

Payments
Payments take place directly between guest and host and are not processed through the platform. Any cancellations or refunds follow the host’s stated conditions.

ETKerteminde and the platform’s operator are not responsible for the accommodation, the listings or any disputes between guest and host.

These Booking Terms (“the Terms”) apply to all accommodation inquiries made through the platform, operated by SevenYellowMonkeys on behalf of ETKerteminde under Kerteminde Municipality.

The platform facilitates contact between guests (“you”) and independent hosts (“the host”).
When you inquire about accommodation through STAY (the platform), you enter a direct agreement with the host outside the platform.

All listings, descriptions, and house rules are provided and maintained by the host.
The platform does not own, operate, inspect, or guarantee any accommodation.

The Booking Terms are governed by:

  • Danish law, including the E-Commerce Act (Lov om tjenester i informationssamfundet, nr. 227 af 22. april 2002), implementing EU Directive 2000/31/EC on electronic commerce;
  • the general principles of Danish obligations law (aftaleret), under which an intermediary that merely facilitates a contract is not a contracting party;
  • and relevant EU consumer protection law.

By submitting an inquiry through the platform, you acknowledge and accept that STAY acts solely as an intermediary for contact between guests and hosts, and not as a landlord, travel agency, booking agent, payment provider, or guarantor.

The platform provides:

  • a digital platform where guests can discover local accommodation and send inquiries directly to hosts;
  • tools for communication between guests and hosts;
  • support for technical questions concerning the platform.

The platform does not:

  • own, manage, or control any listed accommodation;
  • act as a booking agent, payment provider, landlord, travel agency, or guarantor;
  • mediate disputes or act as an insurance intermediary.

Accommodation listings and related information are provided and maintained by the individual hosts, who are solely responsible for their accuracy.

When you submit an inquiry through the platform, you are contacting the host directly.

Any accommodation agreement is made solely between you and the host and not with STAY.

The host is responsible for:

  • ensuring the accommodation is safe, clean, and accurately described;
  • complying with all applicable local laws and regulations, including short-term rental and tax obligations;
  • setting their own house rules, pricing, availability, and cancellation terms.

As a guest, you are responsible for:

  • providing accurate information when making an inquiry;
  • respecting the host’s property, neighbours, and house rules;
  • reviewing and understanding any terms agreed directly with the host before confirming a stay.

All payments related to a stay are handled directly between the guest and the host.

  • Payments for accommodation take place directly between the guest and the host and are not processed through the platform.
  • The platform does not process, facilitate, or manage payments between guests and hosts.

Cancellations and refunds follow the host’s policy stated on the listing or otherwise agreed directly between guest and host.
  • Hosts may define their own cancellation terms.
  • Any refund must be agreed and handled directly between the guest and the host.
  • The platform does not determine refund eligibility and cannot override a host’s cancellation policy.
If a stay cannot be completed due to force majeure (e.g. natural disaster, public health emergency, or similar extraordinary event), guests should contact the host directly to agree on a solution.
Guests must treat the accommodation and property with care and respect. You are responsible for any damage, loss or breach of rules occurring during your stay. If damage or misuse occurs, the host may request compensation directly. The platform is not responsible for guest conduct, property condition or damages occurring during stays.

Any disagreement, damage claim, cancellation issue, or other dispute arising in connection with a stay must be resolved directly between the guest and the host.

The platform does not mediate, arbitrate, or otherwise intervene in disputes between the parties.

However, communication exchanged through the platform may be used by either party as documentation for insurance purposes or private dispute resolution.

All personal data is handled according to the Privacy Policy of the platform and in compliance with the EU General Data Protection Regulation (GDPR) (Regulation 2016/679).

By using the platform and submitting an inquiry, you acknowledge that your information may be used for:

  • facilitating communication between guests and hosts;
  • providing technical support and platform administration.

To the extent permitted by Danish law, Fonden Kerteminde Erhverv and the platform’s partners shall not be liable for:
  • cancellations, losses, damages, or disputes between guest and host;
  • inaccurate listings, unavailable accommodation, or unfulfilled stays;
  • indirect, consequential, or punitive damages.
The platform’s role and liability are strictly limited to providing access to its digital tools and communication functionality.

These Terms and any disputes arising from or relating to the use of the platform are governed by Danish law.

Unless mandatory consumer protection rules dictate otherwise, jurisdiction rests with the District Court of Odense (Retten i Odense).

By submitting an inquiry through this platform, you acknowledge that you have read, understood, and accepted these Booking Terms, as well as the platform’s Privacy Policy and general Platform Terms.

If you do not agree to these conditions, please do not submit an inquiry through the platform.
